People of the State of Illinois v. E. G., February 1, 2007, Finding of No Probable Cause. Charge Dismissed.

Client was sitting in his car, which was parked on the west side of 81st Street near Harvard Avenue in Chicago. Client's friend was sitting in the front passenger seat. It was about 8 o'clock in the evening and the two friends were just talking to each other. Two Chicago Police officers rolled up from behind in an unmarked squad car, ordered Client and Client's friend to exit Client's car and searched Client, his friend and his car. Police officers reported that they found crack cocaine in Client's car. Client was arrested and charged with Possession of a Controlled Substance. A preliminary hearing was held in February, 2007, in Branch 38 on 111th Street. The police officer who testified at the hearing stated that he saw Client walking across Harvard near 81st Street. He said that Client looked in the officer's direction and then quickly threw a small item into the front seat of a parked car. During cross-examination, it was revealed that no drugs or cash money were found on Client's body. Nor did the police officer observe Client engaged in any drug transactions or illegal activity.
