DuPage County Criminal Defense Lawyers Association

Publications : I have given presentations for the DuPage County Bar Association, including one on Drug Asset Forfeitures (Dec 99). In addition, I published an article in the DuPage County Bar Association's "Brief," regarding expungements and explaining the circumstances under which a person can have a particular record of arrest expunged from his or her permanent record.

Additional Information : As an Assistant State's Attorney, I handled thousands of cases, from petty traffic offenses to the most serious felony cases. Having had that invaluable experience as a prosecutor, I am uniquely able to assess a client's chances of success in the local criminal courts.

Additionally, I've had the opportunity to befriend many of my courtroom adversaries as well as courtroom staff. As a result, I am often able to negotiate from a familiar standpoint that typically benefits my clients.

During the course of my 6 years at the State's Attorneys office, I spent approximately ten months working on domestic violence cases, one year exclusively on DUI cases, and the last 14 months handling high-volume drug delivery/trafficking cases. Through these assignments, I became intimately familiar with constitutional issues of search and seizure, and the many bases for the suppression of evidence.

As a trial attorney, I had the benefit of trying hundreds of cases as a prosecutor, and have utilized those skills in hearings and trials for my clients. In addition to having an active trial practice, I train and coach a high school trial team which has been in the Illinois State competition finals for the past three years, and have advised the Loyola law school trial team (1994 - 1998). In this sense, I am an example of a person who not only can successfully try a case, but can teach others with less experience and training how to be effective advocates in a courtroom.

Drug Crimes

Wheaton Drug Crimes Lawyers

Naperville Drug Possession Lawyers · DuPage County Drug Trafficking Attorneys

Assistant State's Attorneys throughout Illinois are under increasing pressure to prosecute narcotics offenses to the fullest extent of the law. Using tactics that range from illegal search and seizure of property to trumped up felony charges of conspiracy or intent to deliver, they often trample on civil rights, while hoping to scare people into accepting a plea agreement.

If you have been charged with a drug crime in Kane County or DuPage County, Illinois, you will be facing a confusing, and often frightening, criminal justice system. Hiring an experienced attorney to navigate the system and help you come out on the other side with the best possible outcome is an important first step.

At the Law Offices of Michelle Moore & Kim DiGiovanni, we know that the criminal charges you face are only a portion of everything you and your family are going through right now. As former state prosecutors with more than 20 combined years of criminal law experience, we have seen too many people get intimidated out of fear for their freedom and worry about their future. By taking a responsive, professional and aggressive approach to helping our clients through their cases, we have earned recognition as the preeminent female criminal defense team in the region.

We have experience successfully representing clients charged with every type of narcotics offense in state and municipal courts, including:

  • Misdemeanor and felony marijuana possession
  • Felony cocaine possession with intent to distribute
  • Drug cultivation and manufacturing, grow operations and meth lab charges
  • School zone violations
  • Driving under the influence of narcotics (DUI)
  • Prescription drug offenses
  • Internet drug offenses
  • Minor in possession of an illegal narcotic

Count on the Law Offices of Michelle Moore & Kim DiGiovanni to serve as your Wheaton drug crimes attorney. Why? Because who you hire as your defense attorney can be even more important than the criminal charges you are facing. Law is a branch of politics, and as former prosecutors, we are well known and respected by the state and local prosecutors, police officers, and judges presiding over Kane, DuPage, Kendall and DeKalb criminal cases. Domestic Violence

Wheaton Domestic Violence Lawyers

Naperville Domestic Battery Lawyers · Kane County Spousal Abuse Attorneys

People often have trouble accepting that domestic battery is a crime of violence. If you are convicted, your record could include a felon assault charge that will forever label you as a violent offender. Many people charged with domestic assault are surprised to learn that they face prosecution, even when the victim doesn't want to press charges. Under Illinois law, a person arrested for assault at the scene of a domestic disturbance is subject to the decision of the State's Attorney, not the victim.

If you are facing charges of domestic battery or any other offense related to domestic violence, talk to an attorney at the Law Offices of Michelle Moore & Kim DiGiovanni right away. We are former prosecutors with more than 20 combined years of experience handling domestic assault cases from both sides.

We Do Everything Possible to Keep You Out of Jail

For many people charged with domestic battery, it is their first time entering the criminal justice system. It's a scary place with threats of jail time coming from all directions. As former prosecutors ourselves, we know that prosecutors are often willing to listen to reasonable alternatives to convicting a person of a battery charge. We work hard to appropriate education and rehabilitation programs that will allow you to avoid a conviction after successful completion.

Before you say anything to the police or prosecutor, let us talk to you about your rights and how we can help. Contact us if you are facing charges for any kind of domestic offense, including:

  • Domestic battery, assault
  • Sexual assault
  • Child abuse, child endangerment
  • Harassment, stalking
  • Restraining order violations, violating an order of protection

Criminal defense lawyers Michelle Moore and Kim DiGiovanni have earned respect and recognition from prosecutors and judges in counties throughout northern Illinois.

From our offices in Wheaton and St. Charles, we represent individuals charged with domestic battery in Kane County and DuPage County, Illinois. Contact us to talk to an experienced Wheaton domestic violence attorney today.

Criminal Appeals

Wheaton Criminal Appeals Lawyers

Naperville Appellate Court Lawyers · Illinois Criminal Defense Attorneys

If you accepted a plea agreement with a prosecutor or were found guilty in a trial, you have the legal right to appeal. The Law Offices of Michelle Moore & Kim DiGiovanni has earned a reputation in courts throughout the region for our intelligent, insightful strategies in criminal appeals cases.

As former prosecutors with more than 20 combined years of criminal law experience, we have seen firsthand the mistakes defense attorneys make in suppressing evidence, as well as the errors judges make in deciding on legal motions and instructing juries. If you have a sense that your prior defense attorney committed an error that violated your rights, or the judge ruled inappropriately on a legal issue, call us to discuss the circumstances of your case. We will provide a free initial consultation and will give you an honest evaluation of whether a court is likely to consider your appeal.

What Does It Take to Move Your Appeal Forward?

After a conviction, either by plea or by jury trial, you have the option of appealing your verdict and your sentence. Filing an appeal is a multistep process, beginning with a written motion of intent to appeal. This motion will include the precise decision or court action that resulted in a violation of your rights.

It is critical that the attorney handling your appeals understands legal precedent in Illinois case law. Your lawyer must be able to articulate how the trial process deviated from legal and constitutional requirements. This requires skilled, intelligent writing and arguing by a law firm that understands the investigative and discovery processes. Unless your motion to appeal gets past the evidentiary hearing, your appeal will likely fail or require a petition to a higher court.

Our firm offers a team of skilled, experienced trial lawyers who know the importance of clear, concise legal writing to present your case. We have extensive knowledge of the appeals process and judges' expectations in courts throughout northern Illinois counties.

Financial Crimes

Wheaton Financial Crimes Lawyers

Naperville Fraud Defense Lawyers · Kane County White Collar Crimes Attorneys

Perhaps no other criminal offense is as complex as a financial crime involving fraud or embezzlement. The evidence is often complicated and the charges typically include dubious felony counts of conspiracy.

If you were charged with a felony financial crime in Illinois, you should be aware that very few criminal defense law firms have the professional resources and knowledge to successfully handle the complex nature of these types of cases. The Law Offices of Michelle Moore & Kim DiGiovanni offers the skills and insight you need for an aggressive, effective defense.

As former Illinois State prosecutors, we have more than 20 combined years of criminal law experience in cases involving fraud, embezzlement and identity theft. Because of our name recognition and reputation for excellence in Kane County and DuPage counties, we have earned the opportunity to work with many of the top independent forensic accounting specialists in the region. We come prepared with expert testimony to challenge the prosecution and clearly define the evidence to obtain the best possible outcome for your charges.
