Juvenile Law

Mobile, Alabama Juvenile Delinquency and Dependency Attorney Christine Hernandez

Juvenile Law | Truancy Cases | Lawsuits Involving Minors | Defense of Youthful Offenders

I am Alabama juvenile law attorney Christine Hernandez. I was a teacher for 14 years before I became a lawyer, and I have spent my entire career working with young people.

My background gives me insight into the value of helping my clients solve the real problem — not just the legal problem. I will give you the legal support your case requires, and work with you to get any additional support and treatment you need outside of the courtroom.

Contact me online or call 251-479-1477 to schedule an appointment.

Juvenile Dependency and Legal Paternity

Juveniles need adults in their lives — both emotionally and legally. No matter how mature they may be, the law requires someone to have the legal authority to make decisions on their behalf.

I work with grandparents, foster parents, step-parents and others to help them obtain guardianship over loved ones who are under 18.

I also work with people who are seeking to obtain a legal paternity degree in order to set up a child support order and rights to custody and visitation.

Juvenile Delinquency and Criminal Defense of Minors

Juvenile delinquency is essentially criminal defense of minors. I represent young people in juvenile delinquency hearings, in transfer hearings to determine if they should be charged as adults, and in adult criminal courts:

  • Criminal mischief, such as toilet-papering a tree
  • "Boom box" tickets
  • Drug and alcohol offenses, including underage drinking
  • Theft and property offenses, burglary and robbery
  • Gang involvement
  • Gun violations, including weapons at school
  • Probation violations
  • Murder

I also handle civil cases where a minor is the plaintiff, such as lawsuits where a young person's rights have been violated.

Additional Services

Same-Sex Families:

So you think you know your rights and you think you are protected?
Think again!

Although the Constitution provides a guarantee that full faith and credit shall be given in each state to the public acts, records and judicial proceedings of every other state; it does not mean that every state must provide the same rights to their respective citizens. In addition many states attempt to regulate the morality thereby judging our families unfairly.

Many same-sex parents have never given their rights much attention until something happens to make them see that the right they thought they had doesn't exist.

Take a few minutes and read this information. Discuss with your partner what kind of protection you want and need to feel secure from outside intrusion into your life. Some points included in this brochure to discuss are:

  • Family Education
  • Estate planning
  • Financial planning
  • Family planning
  • Types of contracts
  • Types of legal protection you may need
  • Power of attorney...what exactly is it???

Some Methods to achieve Legal Protections for Same-Sex families

Some specific types of legal protection that could benefit same-sex couples are as follows:

  • General Powers of Attorney
  • Medical Powers of Attorney
  • Financial Powers of Attorney
  • Autopsy and Disposition of Remains Power of Attorney
  • Guardianship Papers
  • May be evidence of De Facto Parenting Status
  • Quick Claim Deeds with Right of Survivorship
  • Nomination of Guardian of a Minor Child
  • Medical Consent to Treatment
  • Hospital visitation authorization
  • Adoption petition
  • De Facto Parenting Consent Agreement
  • Joint Custody Consent Agreement
  • Separation Agreement
  • Power of Attorney Delegation of Parental Powers
  • Cohabitation Agreement
  • How to pay the bills
  • How property is distributed

Education is Power!!!
So educate yourselves

  • Educate yourself about how much you know about your partner
  • Educate yourself about how much you know about your partner's family...discuss whether they will fight you for survivor benefits or custody of your children
  • Educate yourself about what parenting methods you and your partner share and which ones you do not
  • Educate yourself about the roles and responsibilities of parenting and then educate yourself about how a same-sex couple has to go about making sure they can carry out those roles and responsibilities

Identify your individual relationship needs:

  • Do you rent or own a home together?
  • Do you lease or own a car together?
  • Do you rent or own other real property together?
  • Do you share a bank account or do you have separate accounts?
  • Do you share credit cards?
  • Do you know your partner's social security number?
  • Do you have a place that you keep important papers where both of you have access in case of an emergency?
  • Could you sign for the baby to be discharged?

Education Law

Client-Focused Education Law Attorney Christine Hernandez in Mobile, Alabama

Special Education and IEPs | Title 9 and Gender Equity | First Amendment Cases | Teacher Assault | No Child Left Behind Issues

For my entire career as a teacher and an attorney, I have been committed to helping people solve real problems.

I am education law attorney Christine Hernandez. Before I became a lawyer, I worked as a teacher for 14 years, and the same problem solving skills I taught my students are the same skills many of my clients need the most today.

If you are a parent, student or teacher with an education law issue, contact me online or call 251-479-1477 to schedule an appointment.

I handle education law cases related to K-12 schools, post-secondary educational institutions, public schools and private schools in a wide variety of areas:

  • Special education: Schools are required by law to provide all children with a free, appropriate education.

When a child has special needs, the school must develop an IEP (individual education plan) and ensure the proper personnel are trained to help your child meet its goals.

If you are the parent and you're school is not implementing a proper IEP for your child — or if you are a teacher facing discipline or job loss due to a school district's failure to provide training — I can help.

  • Title IX gender discrimination issues: I represent students or teachers in gender equity claims related to Title IX, the federal Equal Opportunity in Education Act.

  • First Amendment and Constitutional issues: I handle school cases involving freedom of speech, freedom of religion and the establishment of religion.

  • Teacher assault cases: Assault on a teacher in Alabama carries a charge of assault 2nd, which is more serious than general assault. I represent students or teachers involved in allegations of assault.

  • Truancy and contributing to the delinquency of a minor
