I am a sole practitioner. I represent only persons charged with crimes in the States of Florida and Texas, and in the Middle District Federal Court in Florida. My practice is located in Kissimmee, Florida. I practice at the trial level only. I am a member of the National Association of Criminal Defense Lawyers, the Florida Association of Criminal Defense Lawyers, the Central Florida Association of Criminal Defense Lawyers, and the American Bar Association.

I was born in San Angelo, Texas in 1951 and graduated from Central High School there in 1969. I joined the U.S. Army in 1971 and spent 20 years in the Field Artillery as a howitzer section chief, and a forward observer/liaison officer. I also was a drill sergeant at Ft. Sill, Oklahoma. I retired as a Staff Sergeant from the Army in 1991. I am married, have 3 grown children, a stepson, and six grandchildren. I like to snow ski, golf, and scuba dive.

I have served as a senior felony attorney for the Public Defender for the last 6 years.

My motto at DON WAGGONER LAW, P.A. is "Fighting For Your Rights." If you have been accused of a crime, you are the underdog. My motto means that I make sure that the state or federal government, doesn't abuse your rights as a citizen and as a person accused of committing a crime. You have certain rights that any prosecutor and court may ignore. I am here to make sure your rights are not ignored.

Here are the rights I make sure you get if you hire me:

  1. Once arrested, the absolute right to a reasonable bond being set either at your first appearance (usually takes place within 24 hours) or as soon after that as possible.
  2. The right to have me present when you are questioned by law enforcement or any one else, before, during, and after your arrest. If I am not present when you are questioned, or another attorney if you don't hire me, you should not make any kind of statement whatsoever.
  3. The right to have me present at your arraignment, or to waive your appearance at your arraignment, and to get a trial date set for you. You have the right to plea guilty or no contest at this point, but I advise that you do not until you have consulted an attorney.
  4. The right to have me review the evidence the state intends to present against you, go over that evidence with you, and discuss with you the merits of your case.
  5. The right to have me discuss your case with the prosecutor and to negotiate for a reasonable plea offer.
  6. You have the absolute right to have a trial regardless of whether you are innocent or guilty, regardless of any counsel to the contrary you may receive, and regardless of any plea offers that may be extended to you.
  7. You have the absolute right to make the state prove any accusations against you beyond and to the exclusion of every reasonable doubt.
  8. You have the right to have a jury determine whether the state has presented enough evidence to convince it beyond a reasonable doubt that you are guilty of the accusations against you, or whether you are not guilty because the state did not prove the accusations beyond a reasonable doubt.
  9. You have the right to make pre-trial motions and to have the court hear evidence and argument concerning those motions and make a timely ruling on those motions.
  10. You have a right to copy or inspect the evidence the State intends to use against you, to investigate the evidence to be presented against you and to present a defense against that evidence by presenting your own evidence and witnesses. (The right to pre-trial discovery does not exist in Federal court).
  11. You have a right to depose and, at trial, cross-examine the state's witnesses.
  12. You have a right to have me, or another attorney present with you at any critical stage of the case and you have a right to be present at any hearings concerning your case.
  13. If you plea guilty or no contest, or if you are found guilty after a trial, you have the right to have me to represent you at your sentencing, to present any mitigating evidence, and to present witnesses on your behalf.
  14. You have the right to appeal any decision made by the court against you, even if you plea guilty.
  15. If you are not a U.S. citizen and are convicted of a crime either by plea or by jury trial, your right to remain in this country may be in jeopardy.
  16. Finally, you have the right to only be charged a reasonable and fair price for your defense.
