James Folsom, Attorney at Law

800-Kick-DUI

In criminal cases, "I WROTE THE BOOK," literally. The exact title is REVERSIBLE ERRORS IN FEDERAL CRIMINAL CASES. It's published by Knowles Publishing Company out of Fort Worth, Texas and it covers all the cases that were reversed by the Federal Circuit Courts.

I was a prosecutor in four different jurisdictions, i.e. for the City of San Antonio, for Bexar County, Texas, for Nueces County, Texas and for New Castle County, Delaware. As a prosecutor for the State of Delaware, I rewrote the drug forfeiture laws that they are still using today. On the other side of the coin, I was selected out of dozens to be the first Federal Public Defender assigned to Delaware. I'm licensed and have practiced before all the courts of Delaware, the Federal District Court of Delaware, the third and fifth Federal Appeals Courts and the United States Supreme Court.

I have prosecuted and defended everything from jay-walking to capital murder, from possession of a joint of marijuana to trafficking in tons, from sodomy to following too close. On the last capital murder case I handled, the co-defendant got the death penalty while my client only got three years.

And while I don't claim to win every case I have tried-- like some unscrupulous local attorneys falsely claim-- I have won the majority of the cases I've handled.

Since your looking at my site, I'll give you some free advice. If a policeman reads you your Miranda rights shut up! Most people don't realize it but you don't have to be guilty to incriminate yourself. I'd like to give an example: Suppose you decided to take a trip to New York. You went for one day and came back and no one knew you went. But on that day, your worst enemy was killed when someone matching your description pushed him off the Statue of Liberty. The police --through their investigation-- learn that you and he were enemies, so they go to your house and question you. If you don't exercise your rights, you could be the one that closes their file. And your statement that you were in New York that day could be the one thing the jury relies upon to convict you. In other words, don't talk to the police-- talk to your lawyer.

Firm Profile

MY TRIAL PHILOSOPHY = AGGRESSIVE COMPASSION

While I only practice in a few areas of law, mainly those cases  where trial is a real possibility, I feel that aggressiveness is the one key element in providing effective legal services. In those legal disputes the other side is always focused on obtaining all of their objectives, which are usually to your detriment. Thus, your best defense is a strong aggressive offense. According, I combine my knowledge, experience, and resources with the aggressiveness needed to produce the best possible results.

I don't do real estate, wills or bankruptcy, so excluding my business clientele, most of my clients come to me because they're physically suffering from being hurt in an accident or emotionally suffering because they are facing criminal charges. That's why, in conjunction with my aggressiveness, I strive to provide my clients with compassion that is essential to an effective attorney-client relationship. Effective legal representation requires a complete openness, and an understanding of their needs emotionally as well as legally.
