The Law Firm of John Sinclair has been in business since 1983 and was started with the idea of providing high quality legal services to the community at an affordable price. With this extensive service to the community, the firm has the experience and expertise necessary to provide its customers with the very best service available.

We primarily emphasize criminal and civil litigation. We handle all types of criminal cases, misdemeanors, felonies and traffic with a special emphasis on driving while intoxicated (DUI), vehicular assault, vehicular homicide, and domestic violence. We also practice in the United States Federal Court in Tacoma. We also handle civil cases with an emphasis on real estate and general business matters.

Biography

John Sinclair started his private law practice in Olympia, Washington in 1983 after three years of employment as the Contracts and Regulations Administrator at the State Department of Corrections. His law practice has consistently received high grades from its peers being rated high to very high by Martindale & Hubbell, a National Independent law rating organization. A substantial portion of Mr. Sinclair’s practice involves criminal defense. Mr. Sinclair frequently teaches law related classes for various professional associations. Mr. Sinclair was an adjunct professor at Centralia College in 1983-1984 and was a regular instructor for the Washington State Criminal Justice Training Commission from 1981-2004. Mr. Sinclair also frequently testifies before the Washington State Legislature on law related legislation.

Mr. Sinclair graduated from San Francisco State University in 1976 and from Gonzaga University School of Law in Spokane, Washington in 1979. He is licensed to practice before the following courts: United States Supreme Court; United States Court of Appeals, Ninth Circuit; United States District Court for the Western District of Washington; State of Washington Supreme Court; and State of California Supreme Court. He is licensed to practice in all courts in Washington and California. Mr. Sinclair is also a Board Member on the Board of the Washington Association of Criminal Defense Lawyers 2006-2008 (WACDL), the Washington State Bar Association Criminal Law Committee, and a member of the National Association of Criminal Defense Lawyers (NACDL).

Ashlee Strickland

Legal Assistant

Ashlee Strickland has worked for the firm as a legal assistant since 1999. She has extensive experience and knowledge of the law. She consistently receives high marks from clients for her assistance and for caring about their individual cases. Ashlee is also a licensed Notary Public.

Doreen Sinclair

Financial Manager

Doreen is the comptroller and financial manager of the office. She is a graduate of the Evergreen State College and previously worked for the State of Washington, retiring in 2005 as an Operations Manager with the Department of Transportation. She also manages Sinclair State Street Properties LLC. Doreen is also a licensed Notary Public and a Certified Real Property Administrator with the Building Owners and Management Association (BOMA).

Domestic Violence

RCW 10.99.020 defines domestic violence

Domestic violence is a crime committed by one family or household member against another. The typical offenses misdemeanor domestic violence crimes are:

  • Assault in the fourth degree (RCW 9A.36.041)
  • Malicious mischief in the third degree (RCW 9A.48.090)
  • Violation of the provisions of a restraining order, no-contact order, or protection order restraining or enjoining the person or restraining the person from going onto the grounds of or entering a residence, workplace, school, or day care, or prohibiting the person from knowingly coming within, or knowingly remaining within, a specified distance of a location (RCW 10.99.040, 10.99.050, 26.09.300, 26.10.220, 26.26.138, 26.44.063, 26.44.150, 26.50.060, 26.50.070, 26.50.130, 26.52.070, or 74.34.145); -Stalking (RCW 9A.46.110); and
  • Interference with the reporting of domestic violence (RCW 9A.36.150).

Conviction requires treatment. RCW 26.50.150 WAC 388-60

The Department of Social and Health Services shall adopt rules for standards of approval of domestic violence perpetrator programs that accept perpetrators of domestic violence into treatment to satisfy court orders or that represent the programs as ones that treat domestic violence perpetrators. The treatment must meet the minimum requirements established by the Department of Social & Health Services.

Conviction results in loss of right to carry a firearm, RCW 9.41.040.

A conviction related to a domestic violence crime results in the loss of a person's right to carry a firearm, which includes possession of a firearm for any purpose, including for hunting or target practice or for job related firearm possession. There are no exceptions.
