I have been defending those accused of DUIs for most of my 20 plus year career in the law, first as a public defender and since ’91 in private practice. I am not only one of the founding members of the National College for DUI Defense, but I am also one of the first lawyers in the nation to be Board Certified in DUI defense by that organization.* I am one of only 3 lawyers so certified in Washington currently.

A 1975 graduate of Johns Hopkins University, and recipient of a law degree from the University of Puget Sound Law School (Magna Cum Laude 1987), I have over 20 years experience defending DUIs. I have well earned my reputation as a tenacious trial advocate in well over 1,000 DUI and criminal cases, beginning as a Staff Attorney for the Seattle-King County Public Defenders Association and in over 15 years of private practice. In addition to being a graduate of the rigorous National Institute for Trial Advocacy, I was certified in administering Standardized Field Sobriety Tests in 1996, and again in 2001. I was named "Super Lawyer" by Washington Law & Politics in 2006, 2007, 2008 and 2009.

My father, also a lawyer, referred me to Vern. I’ll go give him a hug right now for that referral. I faced a DUI with a refusal; I failed the sobriety tests and also had numerous verbal altercations with the officers. Needless to say, my police report was a painful sight. Worst of all, it was in Bellevue which offered basically nothing in the way of plea bargains. People told me I was wasting my money hiring an attorney. They were wrong. Vern set up a motions hearing where he made the officer look utterly ridiculous. The hardest thing I had to do was not crack a smile. Vern has defended my wife and I in separate DUI cases and neither of us have a DUI on our record. In my case, I failed field sobriety tests and blew a .22. I was guilty.

I was also involved in a boating accident where, while in command of a large power boat, I collided with a dark blue sailing vessel with dark blue sails that was improperly lighted at night. Naturally the state saw fit to prosecute the big bad power boat that “ran into” to poor little sail boat. In this case I was not impaired and the fact that there was no field sobriety test or blood alcohol test worked both for and against me. While there was no evidence of gilt, there was no evidence of innocence either.

The state accused me of Boating While Under the Influence and then, on the day the trial began, added the charge of Reckless Endangerment. The case went to jury trial and after Vern shot gaping holes in all nine of the prosecution’s witnesses including three police officers and mopped the court room floor with the prosecutor, the judge denied his request to have the case dismissed. The judge said he was going allow the case to go to the jury only after giving the prosecutor the benefit of the benefit of the benefit of the doubt.

Over the course of the nearly one year it took to get to trial, Vern went to task on becoming an expert in boating laws, rules and navigational terminology. It was in part his ability to speak the language and understand the nuances of water bourn travel that allowed him to effectively destroy the credibility of the States parade of witnesses. In addition, during this period of preparation, Vern called and e-mailed me numerous times looking for information about the smallest details surrounding the incident. This assured me Vern was not just handling my case, but immersing himself in finding answers to any possible scenario we might encounter at trial. In the end, Vern’s masterful delivery of an overwhelmingly compelling closing argument toppled the State’s case and I was acquitted on both charges.
