If you are visiting this website chances are you have already made one big mistake: you tried to comply with the arresting officer’s directives, in the hopes of convincing him that you were not impaired, when in fact you should have said nothing and completed no tests, since by law, field sobriety tests are completely voluntary.  In essence, all you did was give the officer evidence to build a case against you.

            Police officers routinely stop cars at night, smell alcohol, and conduct a series of completely meaningless, so-called "field sobriety" tests meant to demonstrate impairment, even though the tests are often not instructed properly and scored incorrectly. Moreover, the tests themselves are designed for failure, even for the most balanced individual because they are presumed to measure two things: balance and ability to follow instructions. Yet, officers seldom, if ever, give proper instructions and even when they do, the scoring is so decidedly subjective, and perfectionist, that no one can pass. For example, there are approximately 80 mistakes that one can make on the walk and turn test, but scoring 78/80 will still result in failure! Is there any other test you can think of, where scoring a 97% will result in anything but an A+? Swaying on the on the one legged stand (OLS) will score you half way to failing, yet there is no instruction on not swaying, so you would have to be a mind-reader to succeed at this test.

Scoring Your Case

If you had 2-5 "Yes" answers = Poor to fair

If you had 6-10 "Yes" answers = Good

If you had 11-15 "Yes" answers = Very Good

If you had 16+ "Yes" answers = Excellent

Too many people just give up when facing a DUI, without consulting a Utah DUI Defense Specialist. The truth is that most DUI's especially first DUI's are either able to be reduced to a lesser charge or eliminated entirely, If the attorney is a trained DUI specialist. Utah DUI's are unlike DUI's anywhere else. Only Utah has a majority of police who believe that alcohol is evil. Only Utah uses their Intoxilyzers with a single breath test rather than two tests, performed twenty minutes apart and within .020 of each other. And only Utah will allow you to become alcohol restricted without informing you of the ramifications.

For most people, the cost of obtaining a DUI attorney is an expense that they were not planning on.  However, most people fail to realize that the most expensive part of a DUI is not the cost of a fine or the cost of an attorney, but rather the cost of increased car insurance, as well as increased health and life insurance, for about five to seven years following conviction. These costs alone can add up to tens of thousands of dollars, not to mention the inconvenience of not being able to rent a car, and sometimes not being able to qualify or re-qualify for life and health insurance. My fees are set at a flat rate to assist you with your budgeting, and if you need to, you can break up payments over a number of months. REPRESENTING YOURSELF IS A HUGE MISTAKE

Some individuals do try to defend themselves without legal assistance, but this is very risky because the penalties can be harsh and very few individuals, despite their education, can understand legal procedure which is where the system will crush you. People make the mistake of speaking with prosecutors about the facts of their case thinking that if the prosecutors only knew them, they would care about their individual circumstances and cut them a break. What a mistake!!!!

Simply put, even if you dedicate weeks to becoming informed about proper procedure and the individual court in which you find yourself, there is no way that the prosecuting attorney will take you seriously, and because you pose no threat to them in terms of litigating the case, you will not be able to negotiate a possible plea bargain. The system is, unfortunately, a pay to play structure and no matter how good your case may be, you will not be able to properly litigate your case. The biggest mistake people routinely make is believing that because they are a good person, and have not done anything illegal before, that the prosecution will take pity on them and cut them a deal.

Nothing could be farther from the truth; I sometimes say that the Pope would be treated exactly the same as a farmer, but for the difference of having legal counsel. Do not forget, the penalties are statutory - prescribed by law in writing; and there is nothing that a prosecutor can or will do for you because they like you or feel as if you don't deserve this on your record. They do not care that you are a single Mom and have to drive your kids to school; they do not care that you have to drive to get chemotherapy each day; and they do not care that you have never had a driving infraction. It simply does not matter.

Obtaining good legal representation is key for a singular reason; a qualified DUI Utah Attorney can litigate the case for years, and pick up on police mistakes which are usually well hidden to the untrained eye; this translates into "staying power" and an unresolved case which prosecutors despise. Power equals persuasion in the area of DUI Utah law especially, because DUIs are so politically motivated and emotionally charged.
