Welcome to the Law Office of Attorney Robert T. Vaughn. Mr. Vaughn is entering his 29th year of private practice having represented clients in Tennessee and 35 states. Mr. Vaughn’s primary practice area is criminal law and he has defended individuals charged under both State and Federal law charged with various crimes including murder, manslaughter, wire fraud and possession and resale of controlled substances of all types. Mr. Vaughn is also recognized throughout the United States for his work in defending those charged with drug paraphernalia at both the state and federal levels.

A 1974 graduate of The University of Tennessee, Mr. Vaughn attended The Nashville School of Law and became licensed to practice law in Tennessee courts in October, 1979. Mr. Vaughn is admitted to practice in Federal Courts in the Middle District of Tennessee, the Eastern District of Wisconsin and the Eastern District of Michigan. He is also admitted before various United States Courts of Appeals, including the 4th, 6th, 8th, 9th, 10th, and 11th Circuits. Mr. Vaughn is also admitted to practice before the United States Supreme Court.

Mr. Vaughn has represented clients in 35 state and federal courts. While not admitted to practice in other states, he has worked with local counsel and entered court under motion ‘pro hac vice’.

Mr. Vaughn has taught law related courses for 25 years at various institutions including Belmont University, various private companies and for the past 9 years served as an adjunct professor at Tennessee State University. Mr. Vaughn has been invited to speak on the issue of drug paraphernalia before the National Association of Criminal Defense Attorneys. Mr. Vaughn’s advice is frequently sought by manufacturers, distributors and retailers of alleged drug paraphernalia.

His articles on drugs and drug paraphernalia have been published by the Drug Law Review, High Times Magazine and Headquest Magazine. Mr. Vaughn has been frequently quoted in local and national publications. He has lobbied and assisted in writing laws in Michigan, Ohio, Hawaii and Washington D.C. For over 25 years, Mr. Vaughn has continually, on an un-interrupted basis, published “The Letter of the Law”, a monthly update involving the manufacture, sale, and prosecution of drug paraphernalia cases.

1) What is a DUI?

In Tennessee, an individual may not drive or be in control of a vehicle if the blood alcohol content is .08 or more. It takes very little to achieve a blood-alcohol level in violation of law.

2) Should I take the breath test?

If you have had no alcohol, the test will prove you have not exceeded the state limits. If you question how much alcohol you have consumed, the breath test may prove disappointing for you. Because of the accuracy of the machines, they are presumed to be accurate and .08 blood alcohol level will get you arrested. You may choose not to blow. Understand that failing to take the breath test as requested by an officer with probable cause, may suspend your license for a period of one year.

3) Can I get a restricted license?

A restricted license is available to first offenders ONLY. If you have a DUI conviction on your record and plead to a second first-offense DUI, you are not eligible for a restricted license during your year of probation but the 2nd year of suspension is eligible for a restricted license. Failure to take the breathalyzer test may suspend your license for one year but one is eligible for a restricted license. Third and subsequent DUI convictions are not eligible for a restricted license of any kind.

4) What are DUI penalties?

1st Offense: 11/29 in jail, suspended, all but 48 hours (24 hours jail/24 hours trash pick-up), 11 months/29 days probation, $350.00 fine, alcohol safety school, various other probation responsibilities, loss of license for one year and court costs.

2nd Offense: 11/29 in jail, suspended, all but 45 days, day-for-day (maybe eligible for work release), 11 months/29 days probation, $600.00 fine, alcohol safety school with extensive probation officer responsibilities, loss of license for two years and court costs.

3rd Offense: 11/29 in jail, suspended, all but 120 days (no work release), 11 months/29 days probation, $1100.00 fine, alcohol safety school, extensive probation responsibilities, loss of license for three years and court costs.

4th Offense: AN “E” FELONY WITH ANTICIPATED JAIL TIME.
