One of the most important initial questions we answer for our clients is what a felony is and what penalties may be assessed if found guilty.

What is a Felony?

Any crime punishable by more than one-year in prison is technically classified as a “Felony”. In Tennessee, felony charges range from murder and arson to computer fraud and sexual crimes. Each is categorized into a specific felony class ranging from capital crimes to Class E Felonies. The crimes in these classes typically have conviction penalties of one year or longer in prison as well as accompanying fines.

Other than a “Capital Crime,” such as First Degree Murder, Class A Felonies are the most serious. Following these, the rest of the felony classes decrease in severity from there (i.e. B, C, D, and E) down to Class E Felonies.

Criminal Attorney-Murder

Nashville, Tennessee

Considered by many to be one of the worst criminal acts, being charged with murder or attempted murder is clearly an extremely serious allegation that requires the advice and representation of an experienced criminal attorney.

At Ridings Law Group, P.C., our Nashville criminal defense attorneys have over 13 years of experience defending those who have been charged with murder, attempted murder, and other violent crimes. We are dedicated to fighting for your innocence and preventing the severe consequences that may accompany a murder conviction. In Tennessee, there are six levels of criminal homicide charges that we will work diligently to defend you against. These include:

First Degree Murder

If you have been charged with first degree murder, you are facing a capital crime with associated penalties. It requires that the act of killing was premeditated and intentional, done during the commitment of another felony, and/or the result of a bomb or other destructive device. Possible sentences include death, life in prison without parole, of life with the possibility of parole.

Second Degree Murder

The conscious killing of another or a death of another resulting from unlawful distribution of Schedule I (LSD, heroin, mescaline) or II (methamphetamines, opium, cocaine) drugs is considered second degree murder. If convicted, you may be facing Class A felony consequences such as 15-25 years in prison.

Voluntary Manslaughter

In the heat of passion, a person may encounter sufficient provocation to elicit irrational behavior. Unfortunately, this irrationality may result in the death of another person; in Tennessee, this is considered a Class C felony voluntary manslaughter. You may face 3-6 years in prison if convicted.

Reckless Homicide

If a person does not intend to harm another individual but can foresee the harmful effects of their actions, the resulting, unintentional death of that person is known as reckless homicide. Although this classification allows for a lower mental culpability, it is still a Class D felony and the conviction carries 2-4 years in prison.

Criminally Negligent Homicide

When the natural and probable result of an individual’s actions is the death of another, Tennessee considers this to be criminally negligent homicide. This murder charge replaced the original charge of involuntary manslaughter and is considered a Class E felony.

Vehicular Homicide

If the death of an individual was the direct result of an automobile, airplane, motorboat, or other motorized vehicle, this may be considered vehicular homicide. Certain provisions must also be met including risky behavior that threatens the health and welfare of another, driver intoxication, drag racing, or driver conduct disregarding posted construction area warnings. Vehicular homicide is a Class D felony with sentences of up to 12 years in prison and a fine of up to $5000.

FEES

 FEES IN CRIMINAL CASES

Fees in Criminal Cases are largely variable, and hard to quote over the internet. For that reason, we offer FREE CONSULTATIONS on ALL CASES so there is no risk to you to call our office. Having said that, in most cases we charge “flat rate fees”.

By that, I mean, we do not bill hourly fees and we pay, for the most part, our own expenses out of those flat rate fees. So you will know, from the beginning, exactly what you will pay for the representation that you will get from our office, to the penny. No hidden costs, or fees. No surprises later down the road. Everything is disclosed at the initial meeting.

While there are exceptions in all cases, fees applicable in most Misdemeanor and Felony cases usually range from a minimum of $750.00 and up, depending on a multitude of factors, including the following

  • the complexity of the particular case;
  • the seriousness of the offense;
  • whether the case is in General Sessions, or Criminal Court;
  • whether or not the case proceeds to trial;
  • and, if so, how long the trial lasts.

There are, of course, other factors to consider when quoting fees that we will discuss in the free consultation. But suffice it to say that there is absolutely no risk in calling us to inquire about your case.
We take all forms of payments, including Visa, Mastercard, Discover, and American Express for your convenience. And, in some limited situations, (given the right set of circumstances) we offer payment plans to certain qualified clients.

WE LOOK FORWARD TO REPRESENTING YOU AND TO DISCUSSING THIS AND OTHER QUESTIONS YOU MAY HAVE AT YOUR FIRST CONVENIENCE. CALL US TO SCHEDULE YOUR FREE CONSULTATION, TODAY.

WE HAVE THE EXPERIENCE YOU NEED, AND THE WORK ETHIC YOU CAN TRUST.
