Preparing a DUI Defense

Was your DUI arrest legal?

South Carolina DUI law is a complex law, with a surprisingly large gray area of actual DUI culpability. Though, only a DUI attorney can expertly scrutinize and challenge your DUI arrest. DUI statutes we’ll examine include:

  • South Carolina law dictates that the police officer’s video camera must begin videotaping as soon as the officer turns the blue lights on.

Under DUI Law: Guilt Must Be Proven

We’ll examine these and other DUI laws to determine the strength or weakness of the case against you.

  • The prosecution must prove that there was a reason, known as reasonable suspicion, for the officer to pull you over. For example, the officer saw you driving recklessly, speeding or swerving over the double yellow line.
  • The prosecution must prove that you were driving any type of motorized vehicle.
  • The prosecution must also prove that you were on the road.
  • Most importantly, the prosecution must establish that you were materially and appreciably impaired.
  • While some statutes are more easily determined than others, the most vital question appears to be whether the defendant was materially and appreciably impaired. This issue is at the core of the argument and presents the biggest challenge in dealing with the DUI statute.

Consequences of a DUI Arrest in South Carolina:

Consequences associated with a driving under the influence conviction are determined by

  • the charge of a first DUI, second DUI, third DUI, or subsequent offense;
  • your blood alcohol level (the higher your BAC, the stiffer the penalties);
  • your agreement or refusal to take a chemical test, such as a breathalyzer (if you refuse, you will lose your license for 6 months, unless you request an administrative suspension hearing);
  • minors being in your vehicle; and
  • your involvement in a DUI accident.

NOTE:  Your DUI defense also plays a key role in determining the final consequences.

Actual DUI penalties, based on the factors above, include:

  • A suspended or restricted license
  • Mandatory jail time or imprisonment
  • Ignition interlock device
  • SR-22 insurance
  • Fines ranging from $400 to $10,000
  • Community service
  • Felony conviction
  • Alcohol and Drug Safety Action Program (ADSAP)

Joseph Preston “Pete” Strom, Jr.

 

Joseph Preston “Pete” Strom, Jr. was born in Columbia, South Carolina in 1959. He attended the University of South Carolina and graduated in 1981 with a Bachelor of Arts.  While attending the University of South Carolina, Pete served as President of Kappa Sigma Fraternity.  

After graduating from the University of South Carolina, Pete attended the University of South Carolina School of Law where he graduated with a  J.D. in 1984.

After graduating from law school, Pete served as law clerk to the Honorable Frank Eppes, a South Carolina state trial court judge.

In 1985, Pete joined the Fifth Judicial Circuit Solicitor’s Office as an Assistant Solicitor. While serving as Assistant Solicitor, Pete handled over 200 drug cases, prosecuting the largest heroin trafficking case in South Carolina at that time, a case involving over 100 grams of heroin. 

After a stint in private practice, practicing as a partner in three law firms, Pete was named United States Attorney for the District of South Carolina in 1993.

At the time he was appointed by Attorney General Janet Reno, Pete was the youngest U.S. Attorney in the country.

As the U.S. Attorney for the District of South Carolina, Pete created the Violent Crimes Task Force in South Carolina, which Attorney General Reno referred to as “a national model for the country through a provocative violent crime initiative”. 

While serving as U.S. Attorney, Pete also served on Justice Department committees relating to organized crime, white collar crime, sentencing guidelines, and juvenile justice; Pete also attended the Harvard University Program for Senior Executives in State and Local Government.

Pete returned to private practice in 1996, founding the law firm of Strom Law Firm.

Pete currently defends criminal cases in State and Federal courts in South Carolina, including drug crimes, drunk driving charges, criminal domestic violence charges, and allegations of mail and wire fraud. 

Pete also represents individuals on the civil side in the following types of cases: class actions, personal injury including traumatic injury, defective products, including defective drugs, nursing home neglect, professional license defense, and predatory lending.

Mario A. Pacella

 

Mario A. Pacella was born in Buffalo, New York in 1972.

Mario graduated from the College of William and Mary in Williamsburg, Virginia in 1994 with degrees in Government and History. While at the College of William and Mary, he was a member of Omicron Delta Kappa, an honorary society for leadership and academic achievement.

In 1997, Mario graduated from the William and Mary School of Law, ranking in the top ten percent of his class.

Immediately following law school, Mario clerked for United States Magistrate Judge James E. Graham in Brunswick, Georgia.

Following his clerkship and prior to joining the Strom Law Firm, Mario served as an Assistant Public Defender in DeKalb County, Georgia. Mario also served as special counsel to the Center for Prisoners’ Legal Assistance in Georgia and assisted inmates with Habeas Corpus petitions and wrote the litigation manual for inmate litigation under 42 U.S.C. Sec. 1983.

Mario is a member of the South Carolina, Georgia, and New York Bars.

Mario is admitted to practice in the following courts:

Mario also represents individuals on the civil side in the following types of cases:   class actions, social security, workers compensation, personal injury including traumatic injury, defective products including defective drugs, nursing home neglect, and predatory lending.

Mario has been named as class counsel in numerous class actions in South Carolina and nationwide.
