My name is Nick Gounaris and I've been representing people with legal issues for over fourteen years. The majority of my law practice is in the Dayton, Ohio area in Municipal, State and Federal Courts but I routinely represent clients all over the country. I earned an undergraduate degree from Miami University and earned a law degree from the University of Dayton School of Law. In order to stay on top of new developments in the legal field, I've been involved as a member of many legal associations including the Dayton Bar Association, The Ohio State Bar Association, The American Bar Association and The Federal Bar Association. I served two years as the President of the local Chapter of the Federal Bar Association. My law practice takes me all over Ohio and across the country. However, I regularly represent clients in Montgomery, Greene, Miami, Preble and Warren Counties as well as in the Federal Courts located in the Southern District of Ohio and throughout the United States. I'm licensed to practice in the State of Ohio, the United States District Court and in the United States Court of Appeals.

DUI Defense

 

Over the past 15 years I’ve helped defend people against DUI charges. The law involving DUI/OVI is always changing and I take the time to stay informed of the latest court rulings or statutory changes. It’s important to contact a lawyer soon after being charged in order to understand your DUI/OVI charge as well as your rights. Here are some questions that you need to ask if you've been charged with a DUI:

What is a DUI?

DUI stands for Driving Under the Influence, and is sometimes called “OVI” (Operating a Vehicle While Intoxicated)

Ohio OVI/DUI laws stipulate that first time drunk driving offenders lose their driver's license for up to one year, pay fines of up to $1000 and spend a minimum of three days in jail. If convicted for DUI, you will have a criminal record, which could impact your ability to travel and find or keep a job.

Who can get a DUI?

Anyone under the influence of alcohol or drugs (illegal or prescription) who is driving or operating a motor vehicle. In Ohio, it's against the law to operate a motor vehicle with a blood alcohol content (BAC) at or above .08%.

If you are convicted of a DUI, you could face significant penalties that may include: Loss or Suspension of driver's license, Probation, Community Service, Fines, License Plate Suspension, Seizure of your vehicle, drug/alcohol counseling, and Jail or Prison time.

What about my Drivers License?

The police probably seized your driver's license when you were arrested for suspicion of driving drunk. State of Ohio automatically suspends your driving privileges for a minimum of 90 days and possibly as long as five years, depending on the circumstances of your arrest and prior DUI offenses. Renewing your driving privileges requires the payment of an additional fine and, in some instances, taking another driver's license exam.

What happens during DUI arrests?

Police officers perform tests to determine your level of impairment. In Ohio, refusing to let an officer measure your blood alcohol content (BAC) comes with the consequence of losing one's license for, at a minimum, a year. It could also lead to a potential jail sentence. Field sobriety tests, though, are optional. Know your rights on this issue!

Will your DUI arrest lead to a conviction?

Not necessarily. DUI tests are far from perfect, and you may be able to challenge their results and fight your DUI charge.

Federal Criminal Law

 

When you’ve been charged with a crime in Federal Court you need to be represented by someone that is experienced with federal statutes, procedures and case law. I am that lawyer.

There are Major differences between State and Federal Courts and knowing those differences can be the key to successfully representing those charged in Federal court.

The federal system is much more complicated and complex than the cases and issues that arise in State court. If you’ve been charged with a crime in Federal court make sure that you question potential lawyers regarding their experience in federal court. Before hiring a lawyer in a federal court proceeding, request that the lawyer show you on PACER (a web site containing all federal cases: www.pacer.psc.uscourts.gov) how many cases that attorney has handled in the particular federal court.

I’ve been representing clients in Federal Court for my entire legal career. I’m licensed to practice in Federal Court as well as in the United States Court of Appeals. I participate in many hours of training on a yearly basis to keep me up to date on issues involving federal criminal defense. As a result, I’m very familiar with the United States Sentencing Guidelines and how they apply on a case-by-case basis. I’m the former President of the Federal Bar Association in Dayton and continue to remain active in the chapter. I subscribe to numerous services that provide me with updates on the latest court decisions allowing me to effectively represent my clients by being as informed as possible.

In my career I’ve represented individuals who have faced a wide range of criminal charges from simple bank fraud cases to those who have been accused of running national drug rings involving thousands of kilos of cocaine and/or marijuana. I’ve handled large quantity narcotic conspiracy cases, bank robbery cases, as well as other cases involving the FBI, ATF, DEA and IRS.
