Areas of Practice

Rape/ Sexual Assault / Statutory Rape / Date Rape / Sexual Battery / Sexual Abuse

Rape or sexual assault is when an individual forces another person to engage in a sexual activity against their will. This can include oral, vaginal, or anal sex and is often accompanied by violence or drugs to get the victim’s compliance. Statutory rape is unlawful sexual activity with a person under the age of consent. Individuals convicted for these charges typically face imprisonment, heavy monetary fines, registration as a sex offender, and sex counseling and rehabilitation.

Solicitation / Prostitution / Pandering

Crimes that deal with exchanging money for sexual activity are vigorously prosecuted. They range from solicitation, or the act of asking to exchange money for any sexual activity, prostitution, the act of exchanging money for sex, and pandering, the solicitation of customers for prostitutes, typically committed by a ‘pimp’.

Child Abuse / Child Molestation / Sexual Conduct with a Minor / Solicitation of a Minor for Sexual Conduct / Child Pornography / Exploitation of a Minor

Any sexual activity with a minor (a person under eighteen years of age) is the commission of a child sex crime. These crimes can also include lewd conduct in the presence of a child and ‘sexual exploitation’ – promoting, selling, aiding, or possessing matter depicting a minor engaged in obscene acts. Sexual exploitation, or child pornography, is often investigated by undercover operations dealing with internet chat rooms and by searching homes and computers for images. These crimes are felonies which carry not only severe penalties such as imprisonment and registration as a sex offender, but also tarnished reputations, making employment, housing, and relationships difficult to maintain. These are the most aggressively prosecuted crimes in the state of California.

Failure to Register as a Sex Offender

Under California law, a person who fails to register as a sex offender can be charged with a felony, punishable by up to 3 years in prison. If one has been required by law to register, they must register each time they change residence within five working days and each year within six working days of their birthday.

Lewd Conduct / Indecent Exposure

Lewd Conduct, also known as indecent exposure, can be described as any sexual act that is indecent or offensive. This can include an individual exposing or touching their genitals, inappropriate touching or grabbing of another person’s breast, buttocks, or genitals, or engaging in sexual activity in a public place. Lewd conduct can be either a misdemeanor or a felony, and conviction can result in stiff legal penalties such as imprisonment, sex offender registration, and loss of custody or unsupervised time with a minor.

Charged with a Violent Crime in Hollywood or Los Angeles?

Any crime in which an individual uses force against another person is considered a violent crime. Violent crimes can range from misdemeanors, such as robbery or simple assault, to serious felonies such as murder, rape, and manslaughter.

Murder / Homicide / Manslaughter

Any crime involving the loss of human life is a serious offense. It is extremely important to understand the differences between the types of crimes that the accused can been charged with. First-degree murder (premeditated killing), second-degree murder, felony murder, and manslaughter are all crimes that carry very different punishments, so it is important to find a Los Angeles or Hollywood violent crimes attorney who knows the elements of these crimes as well as the possible legal defenses unique to each.

Juvenile Criminal Court System in Los Angeles

Juvenile Crimes are prosecuted in a separate legal system with very different procedures from the adult system. There is no trial by jury, with the judge deciding the outcome based on the evidence. However, in many cases the prosecution may push for the juvenile to be tried as an adult depending on the severity of the charge. Serious or violent felonies committed while 16 or 17 years old may also qualify as a strike under the Three Strikes law. Juvenile crimes can include:

The DUI laws are much stricter for persons under the age of 21.  A minor can be found in violation of DUI laws if they have a blood alcohol content of .01 or higher.  If found guilty of DUI, they may lose their license for one to three years.

FAQ

Criminal Defense Question & Answer

Do I need a criminal defense lawyer?

Chances are that if you are asking this question, the most probable answer is yes. If you are under investigation, have been questioned by the police, or have been arrested, you need a lawyer’s expertise and experience to make sure that you receive the best legal advice as soon as possible. We can help you determine if you need an attorney, as well as represent you during the criminal process.

What is the difference between a misdemeanor and a felony?

Misdemeanor crimes usually have little injury or property damage whereas felonies are far more serious. Typical misdemeanors include vandalism, reckless driving, DUI, battery, and theft. Examples of felonies include murder, arson, rape, grand theft, embezzlement, and DUI causing serious injury. Misdemeanors typically carry a far lighter sentence, including less than $1,000 in fines, community service, or short jail sentences. Felonies are punishable by longer periods of incarceration, bail set to $10,000 or higher, and extremely steep financial penalties.

Will I go to jail?

This is one of the most commonly asked questions.  Any criminal arrest has the potential to result in jail time.  That being said, not every person who is convicted of a crime will go to jail.  Many people convicted of misdemeanors, especially if it is a first-time offense, are able to avoid jail.  For example, in a first-time arrest for simple drug possession, there is a very good chance that the defendant will not go to jail, especially if he or she completes an alternative sentencing program under Prop 36.  If you have committed a felony, there is a bigger chance you may be sentenced to serve time in jail or prison.  However, an experienced Los Angeles or Hollywood criminal defense attorney at our firm may be able to negotiate a plea bargain or a reduced sentence that does not include jail.

What are some of the other penalties I may face?

Depending on the nature of your charges, as well as your prior criminal history, you could face probation, parole, community service, license suspension, and restitution to the victim.  However, these penalties can easily be enhanced or lowered depending on the seriousness of the offense you were charged with.
