Practice Area

New York Criminal Defense, Employment Law, and Divorce Attorney

At De Leon and Associates their motto is "Integrity in Practice, Commitment to Excellence". We have a reputation of getting to know their client’s matters well to fulfill their legal needs.

What follows is a brief description of the type of important legal issues we handle.

Criminal Defense – We are experienced in defending clients against a variety of criminal charges in state and federal court. We represent clients involving minor offenses, drunk driving (DWI/DUI), misdemeanor violations, and felonies up to and including homicide. We also represent clients in post-conviction matters, such as parole and probation violations. Criminal cases move quickly, so do not hesitate to contact us.

Drug Defense – Recent FBI reports indicate that nationwide, drugs and drug-related offenses account for approximately one-third of all arrests. Drug crime penalties can be severe in New York or New Jersey. The type of charge is based upon factors such as quantity, intent to sell or distribute, weapons possession or use, or evidence of sales activity. The seriousness and ultimate punishment for drug crimes often depends upon the quantity of the drug, the drug schedule classification, and the purpose of the possession (for personal use or for sale).

DWI Defense – The penalties for DWI in New York and New Jersey are severe. If you are facing a DWI charge, the advice of an attorney can be invaluable. As a former police officer, DWI lawyer Edgar De Leon uses his street smarts and court savvy to fight for your rights every step of the way, regardless of whether you choose to enter plea negotiations or proceed to trial.

Domestic Violence – If you are a victim of domestic violence, or if you have been charged with domestic violence, you need legal representation. As lawyers who practice in both criminal defense and family law, we look at the big picture. We can represent your interests in a complex case that may involve divorce as well as criminal charges.

Family Law – Selecting the right lawyer to handle your divorce, legal separation, custody arrangement, or support payment schedule could make a big difference for you and your family. At De Leon and Associates we will always put you, your children's, and your family's best interests first and give you the best advice possible to enable you to make the most informed decision.

Matrimonial Law and Divorce – A divorce involves more than the termination of a marriage. We provide you with legal representation for divorce-related family law matters such as property settlements, child custody, child support, visitation, spousal support, marital property division, and bankruptcy if necessary. For legal assistance regarding divorce, legal separation, domestic abuse, modification or enforcement of support orders, contact us to schedule a consultation.

High Asset Divorce – People who own a business or have significant property or other financial assets should get legal advice prior to entering into or terminating a marriage. The sooner you seek legal advice, the more your lawyer can do to protect your interests in any future property settlement.

Employment Law – Being discriminated against at work or being wrongfully terminated can result in serious financial and emotional damage. You do not have to put up with it or move on. You have recourse. If you are being sexually harassed or discriminated against at work, we can help.

Custody, Child Support, Alimony, Maintenance, Visitation – When you and your spouse decide to separate or divorce, you will find that it is just the beginning of the difficult decisions you will have to make. De Leon and Associates is a litigation firm. Nevertheless, we will work with you to develop fair and realistic agreements on these tough issues wherever possible, while always protecting your rights and goals. De Leon and Associates mission to help you move on with your life, while keeping the things you have worked so hard for.

Drug Defense

Recent FBI reports indicate that nationwide, drugs and drug-related offenses account for approximately one-third of all arrests. The penalties for drug crimes can be very severe in New York or New Jersey. The charges are based upon quantity, intent to sell or distribute and other factors such as weapons possession or use, evidence of sales activity, having large amounts of money, etc. The seriousness and ultimate punishment for drug crimes normally depends upon the quantity of the drug, the classification under the drug schedule, and the purpose of the possession (for personal use or for sale).

In recent years, certain drugs have emerged and these include marijuana, MDMA / Ecstasy, Rohypnol, crack or crank, heroin, cocaine, illegal prescriptions and GHB.

However, frequently an accusation of drug possession is based upon an illegal search and seizure, or the use of undercover cop’s “buy and bust” street operations. If proper police procedures were not followed or if your criminal law or Constitutional rights were violated, your case could be dismissed. (See article "Arrested in New York City.")

Don't plead guilty without seeing what an experienced law firm can do for you. Cases involving drugs give rise to many issues, and many possible defenses and ultimate results can vary greatly.

We have successfully handled cases ranging from misdemeanor drug possession and being under the influence of a controlled substance to the most serious felony drug possession for sales and transportation of narcotics offenses. De Leon and Associates principle attorney is a former police officer and knows the street and the legal system. Let him work to your advantage today.

DWI Defense

New York DWI Lawyer - Drunk Driving Defense Attorney

The penalties for DWI in New York and New Jersey are severe. If you are facing a DWI charge, the advice of an experienced DWI attorney can be invaluable. As a former police officer, DWI lawyer Edgar De Leon has the street smarts and court savvy to fight to protect your rights every step of the way, regardless of whether you choose to enter plea negotiations or proceed to trial.

In addition to facing suspension of your driver's license and a large fine, the police can start a civil action to take your car, even if this is your first DWI/DUI offense. If you blew over a 1.5, were in an accident in which you were driving drunk, or you had a previous DWI arrest, the police are likely to seek a civil court forfeiture action to take away your car. Money from the sale of your car would go directly to the police department.

At De Leon and Associates, our goal is to minimize the effect the DWI on your life and your pocketbook. The way we do this is by providing you an aggressive defense at the driver's license revocation hearing. While most people do not win at their driver's license revocation hearing, by contesting the revocation our lawyers can obtain good information about the state's case against you. We can then look for holes in the state's case, such as a violation of your constitutional rights during the stop or the arrest

To schedule a consultation to discuss how we can help you with your DWI arrest, contact New York drunk driving defense attorney Edgar De Leon. Se habla español. In Emergencies Only! Call (917) 270-0119.

Domestic Violence

If you are a victim of domestic violence, or if you have been charged with domestic violence, you need experienced legal representation. As a former police officer, domestic violence attorney Edgar De Leon has the street smarts and court savvy to fight to protect your rights every step of the way.

If You are a Victim of Domestic Violence

Many cases of domestic violence start out at a criminal case and change into a divorce case because the victim decides that he or she doesn't want to live with the abusive spouse any more. As lawyers who practice in both criminal defense and family law, we look at the big picture. Our lawyers can represent your interests in a divorce action and help get an order of protection to keep the offender away from you.

If You are Accused of Domestic Violence

If police come to your home in response to a report of domestic violence case, you will likely be arrested. In most cases when someone is accused of domestic violence, police are required to make an arrest. For more information, see the article Police Procedures in a Domestic Violence Arrest. However, just because you are arrested doesn't mean you are guilty.

Some people make false accusations of domestic violence because they are angry with their spouse or to use as leverage in a divorce action. One of the most important questions we ask our clients is did the assault occur. The answer to this question determines what we need to do to protect our client's rights.

As lawyers, we work to see the whole picture of your family as opposed to this one alleged incident. If you are subject to an order of protection, we will seek to negotiate with court to ensure that the order does not unreasonably prevent you from seeing your children or, if you and your spouse should happen to work near each other, from working.

To schedule a consultation to discuss how we can help you with your domestic violence case, contact New York domestic violence lawyer Edgar De Leon. Se habla español. In Emergencies Only! Call (917) 270-0119.
